What is the best way to restructure your business and personal financial affairs?

This is a very difficult question and qualified professional advice is required.

If you are conducting your business affairs through a corporation, the safest route to restructure your affairs and resolve your debts is to first bankrupt the Company, and then if necessary bankrupt yourself.

This is also the most expensive solution and in certain circumstances the added protection of the corporate bankruptcy does not justify its cost.

If you are in the position where you have to wind-up or restructure your corporation, you may also need specialized legal or accounting advice.

There are many questions that need to be answered before a strategy to restructure your financial affairs can be developed:

  1. Is the corporation still operating?
  2. Does the corporation operate from leased commercial premises?
  3. Does the corporation still have employees?
  4. Does the corporation have any secured creditors?
  5. Does the corporation owe money for unpaid employee source deductions, or unpaid GST remittances?
  6. Does the corporation have any assets?
